General Terms and Conditions

§ 1 Scope and Definitions
(1) The following General Terms and Conditions apply to all contracts for the delivery of goods concluded between us (BLOOM Outdoor Möbel GmbH) and a consumer through our online shop (www.bloom-outdoor.com), in their version valid at the time of the order.
(2) A "consumer" within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity (Section 13 of the German Civil Code).
§ 2 Conclusion of Contract, Storage of Contract Text
(1) In the event of a contract conclusion, the contract is concluded with BLOOM Outdoor Möbel GmbH, Industriestr. 112, D-75417 Mühlacker (VAT ID: DE328714962).
(2) The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue.
(3) By clicking the "Order with obligation to pay" button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order is sent immediately after submission via an automated email. With this email confirmation, the purchase contract has been concluded, provided you have selected bank transfer (prepayment or deposit) or cash on delivery as the payment method.
(4) Deviating from this, when selecting PayPal as the payment method (both for full payment and for a 30% deposit), the contract is concluded earlier: In this case, the contract is concluded at the moment you confirm the payment instruction to PayPal.
(5) We store the contract text and send you the order data and our Terms and Conditions by email. You can also view the Terms and Conditions on our website at any time. For security reasons, your specific order data is no longer accessible via the Internet.
§ 3 Prices, Shipping Costs, Payment, Due Date
(1) The stated prices include statutory VAT and other price components. Shipping costs may apply additionally.
(2) The following payment options are available to consumers: Bank transfer by prepayment, PayPal, cash on delivery, and a deposit via PayPal or bank transfer of 30% of the order total.
(3) If the consumer has chosen payment by prepayment or a 30% deposit, they commit to paying the agreed (partial) amount immediately after conclusion of the contract.
§ 4 Delivery Conditions
(1) Unless a different period is clearly stated in the respective product description, the delivery period is 8 to 14 weeks.
(2) For the prepayment method (and agreed deposits), the delivery period begins on the day after the payment order is issued to the transferring bank. For other payment methods (e.g., PayPal or cash on delivery), the period begins on the day after conclusion of the contract. If the last day of the period falls on a Saturday, Sunday, or a publicly recognized holiday at the place of delivery, the next working day shall take the place of such a day.
(3) Should we be unable to meet an expressly agreed delivery date due to circumstances beyond our control (e.g., force majeure, unforeseeable production failures at suppliers), we will inform the customer immediately and determine an appropriate new delivery period.
§ 5 Retention of Title
The delivered goods remain our property until the purchase price owed has been paid in full.
§ 6 Quality of Goods and Color Variations
(1) The quality of the ordered goods is generally determined by the objective product descriptions in the online shop.
(2) We point out that when displaying products on the Internet, slight, technically caused color deviations between the digital product image and the original goods may occur due to different screen settings and individual hardware.
(3) If we provide you with physical fabric or material samples in advance, these serve to illustrate quality, texture, and the basic coloring. Due to production-related batch and lot differences (especially with textiles and natural materials), there may be minor, industry-standard deviations from the sample sent in advance in the finally produced goods. These technically and production-related unavoidable tolerances do not constitute a material defect, provided they do not limit usability and are reasonable for the customer.
§ 7 Right of Withdrawal
Consumers have a right of withdrawal according to the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity:

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last goods.
To exercise your right of withdrawal, you must inform us (BLOOM Outdoor Möbel GmbH, Industriestr. 112, D-75417 Mühlacker, Phone: +49 7041 986 9020, Email: service@bloom-outdoor.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires.
You bear the direct costs of returning the goods. The costs are estimated at a maximum of approximately EUR 400.00.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the quality, properties, and functioning of the goods.

§ 8 Liability for Defects (Warranty)
Statutory warranty rights apply. For all defects of the purchased item occurring during the statutory warranty period, you may, at your option, exercise the statutory claims for subsequent performance, remedy of defects/new delivery, as well as – if the statutory requirements are met – the further claims for reduction or withdrawal, and additionally for damages.
§ 9 Contract Language
The contract language is exclusively German.
